Opinions on Regulating Live Webcast Rewards and Strengthening the Protection of Minors
In recent years, the rapid emergence of new forms of network live broadcasting has played an important role in promoting the development of the industry and enriching the cultural supply. At the same time, the platform main responsibility is missing, the host of good and bad, bounty behavior misconduct and other problems occur frequently, resulting in minors indulge in live broadcasting, participate in bounty, serious damage to the physical and mental health of minors, bring a lot of social problems, the people's public reflected strongly. In order to effectively strengthen the network live broadcast industry norms, to create a good environment for the healthy growth of minors, according to the "People's Republic of China Network Security Law" "People's Republic of China Law on the Protection of Minors" and other laws and regulations, now puts forward the following working opinions.
I. General requirements
Adhere to the socialist core values as the lead, focus on the protection of minors, adhere to the problem-oriented, heavy attack, the symptomatic and comprehensive measures, synergistic cooperation, co-ordination and co-ordination. Through strong regulation and rectification to consolidate the responsibility of all parties, the establishment of a long-term regulatory mechanism, effectively regulate the order of live broadcasting, resolutely curbing the undesirable tendencies, industry chaos, and promote the standardized and orderly development of the network live broadcasting industry, to build a civilized and healthy network ecological environment.
II. Work initiatives
1. Prohibiting minors from participating in live broadcasts and offering rewards. Websites and platforms should adhere to the principle that it is in the best interests of minors to improve and perfect the mechanism for the protection of minors, strictly implement the real-name requirement, and prohibit the provision of cash top-ups, "gift" purchases, online payments and other types of reward services for minors. Websites and platforms are not allowed to develop functional applications that attract minors to reward, and are not allowed to develop various types of "gifts" that induce minors to participate. If a website or platform is found to have violated the above requirements, measures such as suspending the reward function and shutting down the live broadcasting business will be taken from a strict and serious perspective.
2. Strictly control minors engaging in broadcasting. Websites and platforms should strengthen the management of anchor account registration audit, shall not provide network anchor services for minors under 16 years of age, and shall obtain the consent of the guardian for minors between 16 and 18 years of age to provide network anchor services. The use of the so-called "netroots children" live for profit to strengthen the daily supervision, found that the account of violation of the strict measures taken to deal with, and to pursue the responsibility of the relevant websites and platforms.
3. Optimization and upgrading of the "Youth Mode". The "Youth Mode" is a useful way for minors to watch and use after strict content selection. 4. Establishment of specialized service teams. The website platform shall establish a specialized customer service team for minors, and prioritize the acceptance and timely disposal of complaints and disputes related to minors. For minors rewarding adults under false pretenses, website platforms should, under the premise of protecting privacy, promptly check and, if true, process refunds in accordance with the regulations. For websites and platforms that violate the law by providing reward services for underage users, as well as brokers and webcasters that know that users are minors but still induce them to offer rewards, strict measures will be taken to deal with the situation.
5. Regulate key functional applications. Listings and "gifts" are important functional applications that attract young people to "watch" and interact with each other. Website platforms should cancel all reward lists within one month of the release of this opinion, and prohibit the use of reward amount as the only basis for ranking, attracting and recommending webcasters, and prohibit the use of reward amount as a criterion for ranking users. Enhance the standardized design of the name and appearance of "gifts", and do not induce users by exaggerating the display and rendering special effects. Strengthen the security assessment of new technologies and applications, and prohibit the online operation of applications that use the amount of rewards as the only criterion for judgment.
6. Strengthening peak hour management. From 20:00 to 22:00 every day is the peak time for young people to access the Internet, and it is also an important time to regulate webcasting. During the daily peak hours, the number of times a single account live broadcasting room is allowed to "connect PK" shall not exceed 2 times, and "PK punishment" shall not be set up, and no technical realization method shall be provided for "PK punishment". The website platform shall not set up "PK punishment" links, and shall not provide technical realization methods for "PK punishment" to avoid inducing and misleading minors. The website platform shall, after 22:00 every day, force the services under the "Youth Mode" to go offline, and shall not provide or disguise the way to open the regular mode, so as to ensure sufficient rest time for the youth.
7. Strengthening network literacy education. Schools are being encouraged to carry out education on cyberliteracy for minors, fostering minors' awareness of cybersecurity, civilized literacy, behavioural habits and protective skills in terms of cybermoral awareness and codes of conduct, concepts of the rule of law and norms of behaviour on the Internet, capacity-building in the use of the Internet, and the safety and protection of personal property. Guiding guardians of minors to take the initiative in learning about the Internet, and strengthening education, demonstration, guidance and supervision of minors' behavior in using the Internet. Supporting all sectors of society to work together to carry out publicity and education, and to promote the broadening of minors' horizons, the improvement of their quality, the cultivation of their sentiments, and the enjoyment of their bodies and minds.
III. Organizational leadership
1. Raising awareness. All departments and platforms should, from the height of "what kind of future people should be shaped", have a profound understanding of the extreme importance and urgency of regulating live webcasting and strengthening the protection of minors, incorporate it into their important work agenda, combine it with practical refinements and improve the work measures, and ensure that all tasks and requirements are put into place.
2. Strengthening coordination. In accordance with the principle of whoever is in charge is responsible and whoever organizes is responsible, a multidisciplinary and cross-sectoral collaborative work pattern has been established to form a strong, well-coordinated supervisory synergy in which each party plays its own role and is responsible for its own affairs. Adhering to a problem-oriented approach, highlighting key links, and paying attention to ways and means, a strong all-process, all-chain system for the protection of minors is being constructed.
3. Compacting the responsibilities of all parties. Guiding websites and platforms to effectively fulfill their main responsibilities, conscientiously implement relevant policies and regulations, and improve the system requirements for account registration, qualification audit, daily management, and disposal of irregularities. Supervise brokers to carry out the organization, production and marketing of live webcasts in accordance with the law. Educate and guide webcasters to enhance their compliance awareness and comprehensive quality, and actively produce and disseminate excellent cultural content that conforms to socialist core values and reflects the new atmosphere of the new era.
4. Conducting supervision and inspection. An interdepartmental coordination mechanism has been set up to strengthen communication and analysis of the situation and to promote the implementation of the work. Important websites and platforms have been put under supervision to ensure that rectification tasks are completed on time and in good quality. Focusing on the formation of a long-term working mechanism, carry out regular supervision and inspection, and timely study and put forward measures and solutions based on new situations and new problems.
